Data Deletion Request — FlumenChat

In case of any discrepancy between the Spanish and English versions, the Spanish version shall prevail.

If you interacted with a business or individual through WhatsApp and that business uses FlumenChat (a platform operated by FLUMEN SOLUTIONS S.A.S.), your messages may be stored in our systems. This page explains how to request deletion of that information.

§ 01

What data can you request to delete?

Through this form you may request the deletion of the following data stored by FlumenSolutions in the FlumenChat context: • The history of WhatsApp messages exchanged between you and the Tenant. • Attachments (images, documents, audio, video) sent or received in those conversations. • Metadata associated with those conversations (date, time, delivery status). Important note: FlumenSolutions is the Data Processor for your data, not the Controller. If you wish to delete data that the business you communicated with holds about you as its customer, you must contact that business directly.

§ 02

How to submit your request

Send an email to contacto@flumensolutions.com with the following information: Email subject: "Data deletion request — FlumenChat" Information to include in the body of the email: • Your full name. • The WhatsApp phone number from which you communicated (including country code, e.g., +57 300 000 0000). • The name of the business or individual you communicated with through WhatsApp (if you remember it). • A brief description of the request.

§ 03

What happens after submitting your request?

• Acknowledgement of receipt: maximum 5 business days from receipt. • Identity verification: FlumenSolutions will verify that the indicated phone number matches the system records. • Effective deletion of data: maximum 30 calendar days from receipt of the request. • Confirmation of deletion: FlumenSolutions will send you an email confirming that the data has been deleted. In cases of complex requests, FlumenSolutions may extend the term by up to 2 additional months, notifying you before the expiration of the initial period.

§ 04

Can FlumenSolutions refuse to delete my data?

In the following cases, FlumenSolutions may be unable to delete all or part of your data: • Where a legal obligation to retain it exists (for example, tax records that must be kept for 10 years under the Colombian Commercial Code). • Where the Tenant has requested retention of the data for valid contractual or legal reasons. • Where deletion is technically impossible during the backup retention period (maximum 30 additional days). In any of these cases, FlumenSolutions will inform you of the reasons and the estimated retention term.

§ 05

Other rights

In addition to deletion, you may exercise other rights over your data (access, rectification, objection, portability) by sending your request to: contacto@flumensolutions.com. For more information, please consult the site's Privacy Policy. If you consider that your rights have not been adequately addressed, you may file a complaint with Colombia's Superintendence of Industry and Commerce (SIC) at www.sic.gov.co, once you have exhausted direct claims with FlumenSolutions.
